Welcome to MommyDears, operated by AAC Private Limited ("Company", "we", "us", or "our"), a company incorporated under the laws of India. By accessing or using our website at mommydears.co.in, our mobile application, or any related services (collectively, the "Platform"), you ("User", "you", or "your") agree to be bound by these Terms and Conditions ("Terms").
If you do not agree to these Terms in their entirety, you must immediately discontinue use of the Platform. Your continued use of the Platform constitutes ongoing acceptance of these Terms and any future amendments.
2. Description of Services
MommyDears is India's first AI-powered holistic motherhood and postpartum care platform. Our services include but are not limited to:
- AI-powered chatbot support for postpartum queries and guidance
- Personalised postpartum recovery plans based on individual needs
- Mood tracking and AI-assisted mental health check-ins
- Educational content integrating modern medical science and Indian postpartum traditions
- Voice-based support and interaction features
- Community forums and peer connection features
- Facilitation of consultations with registered medical professionals
- Nutrition and lactation guidance resources
We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.
3. Eligibility
To use the MommyDears Platform, you must:
- Be at least 18 years of age
- Be a resident of India or accessing the Platform in compliance with applicable laws of your jurisdiction
- Have the legal capacity to enter into a binding agreement
- Not be barred from receiving services under applicable law
Our Platform is designed primarily for new and expectant mothers, their partners, and caregivers. However, access is not restricted to these groups. If you are accessing the Platform on behalf of a minor or someone who cannot consent, you represent that you have the legal authority to do so.
4. Account Registration
Certain features of the Platform require you to create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Keep your password secure and confidential
- Accept responsibility for all activities that occur under your account
- Notify us immediately at hello@mommydears.co.in of any suspected unauthorised use
We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or outdated, or if your conduct violates these Terms.
5. Medical Disclaimer
MommyDears is not a medical service provider and does not provide medical advice, diagnosis, or treatment. All content, including AI-generated responses, articles, guides, and community posts, is intended for informational and educational purposes only.
Nothing on the Platform should be construed as a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider — such as your obstetrician, gynaecologist, paediatrician, or mental health professional — before making any health-related decisions.
If you are experiencing a medical emergency, call 112 (India) or proceed to the nearest emergency facility immediately. Do not rely on the Platform in an emergency situation.
We do not recommend or endorse any specific tests, procedures, opinions, or treatments mentioned on the Platform. Reliance on any content is solely at your own risk.
6. AI-Powered Services
Our Platform uses artificial intelligence, including large language models, to power the MommyDears chatbot and related features. By using these features, you acknowledge and agree that:
- AI responses are generated automatically and may not always be accurate, current, or appropriate for your specific circumstances
- AI-generated content does not constitute medical, psychological, legal, or professional advice of any kind
- You should independently verify any information provided by the AI before acting upon it
- Conversations with the AI may be stored, reviewed, and used to improve our services, subject to our Privacy Policy
- The AI may not be able to detect emergencies or crisis situations — if you are in distress, please contact a qualified professional immediately
- We make no warranties regarding the accuracy, reliability, or completeness of AI-generated responses
7. User Conduct
You agree that you will not use the Platform to:
- Upload, post, or transmit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Attempt to gain unauthorised access to the Platform, servers, or networks connected to the Platform
- Reverse-engineer, decompile, or disassemble any part of the Platform
- Scrape, crawl, or use automated tools to extract data from the Platform without our written consent
- Distribute spam, chain letters, or unsolicited commercial communications
- Engage in any activity that disrupts or interferes with the Platform's operation
- Violate any applicable local, state, national, or international law or regulation
- Share content that exploits or harms minors in any way
We reserve the right to remove any content and suspend or terminate accounts that violate these conduct standards, at our sole discretion.
8. Intellectual Property
All content on the Platform — including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software — is the property of AAC Private Limited or its content suppliers and is protected under Indian and international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Platform without our express written permission.
By submitting any content to the Platform (such as messages, reviews, or community posts), you grant us a worldwide, royalty-free, perpetual licence to use, reproduce, and display such content in connection with our services.
9. Payments & Subscriptions
Certain premium features of the Platform may be offered on a subscription or one-time payment basis. Where applicable:
- All prices are listed in Indian Rupees (INR) and include applicable taxes unless stated otherwise
- Payments are processed through secure third-party payment gateways
- Subscriptions automatically renew unless cancelled before the renewal date
- Refunds are subject to our Refund Policy, available upon request
- We reserve the right to modify pricing with reasonable notice
- Promotional pricing is subject to specific terms communicated at the time of the offer

10. Termination
You may terminate your account at any time by contacting us. We may terminate or suspend your access immediately, without prior notice, if we reasonably believe you have violated these Terms, applicable law, or acted in a manner harmful to other users or the Platform.
Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, indemnity, and limitations of liability — shall remain in effect.
11. Limitation of Liability
To the fullest extent permitted by applicable Indian law, AAC Private Limited and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with:
- Your use of or inability to use the Platform
- Any content obtained from the Platform
- Reliance on AI-generated information or recommendations
- Unauthorised access to or alteration of your data
- Any other matter relating to the Platform
Our total liability to you for any claim arising from these Terms or the Platform shall not exceed the amount you paid to us in the three months preceding the claim, or ₹1,000 (whichever is greater).
12. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.

13. Changes to Terms
We reserve the right to amend these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where feasible, notify registered users via email or an in-app notification.
Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
